Welcome to Plans2Pick ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of the Plans2Pick website (plans2pick.com) and our travel booking services.

Important: Plans2Pick operates as a travel aggregator and booking platform. We act as an intermediary between travelers and third-party service providers (tour operators, hotels, transport companies, etc.). We do not directly provide travel services ourselves.

By accessing our platform or making a booking through our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our platform.

For the purposes of these Terms:

• "Platform" refers to the Plans2Pick website, mobile applications, and any related services.
• "User" or "Traveler" refers to any person who accesses or uses our Platform to browse, inquire about, or book travel services.
• "Service Provider" refers to third-party tour operators, hotels, airlines, transport companies, guides, and other vendors whose services are listed on our Platform.
• "Booking" refers to a reservation or purchase of travel services made through our Platform.
• "Travel Services" refers to tours, treks, accommodations, transportation, and other travel-related products or experiences.

Our Role as an Aggregator:

• Plans2Pick serves as a marketplace connecting travelers with Service Providers.
• We facilitate the discovery, comparison, and booking of travel services but do not operate, manage, or control the actual travel experiences.
• The travel services are provided solely by the respective Service Providers, and any contract for services is directly between you and the Service Provider.

Information Accuracy:

• We strive to display accurate information about travel services, including descriptions, prices, availability, and images.
• However, this information is provided by Service Providers, and we cannot guarantee its accuracy, completeness, or timeliness.
• Prices and availability are subject to change without notice until a booking is confirmed.

Booking Process:

• All bookings are subject to availability and confirmation by the Service Provider.
• A booking request does not guarantee confirmation until you receive a written confirmation from us or the Service Provider.
• You must provide accurate and complete information during the booking process.

Payment:

• Prices are displayed in Indian Rupees (INR) unless otherwise specified.
• Payment can be made through our secure payment gateway using credit/debit cards, net banking, UPI, or other accepted methods.
• Some bookings may require full payment upfront, while others may allow partial payment with the balance due before the travel date.
• All payments are processed securely, and we do not store your complete payment card details.

Pricing:

• Displayed prices include applicable taxes unless stated otherwise.
• Additional charges (such as travel insurance, visa fees, or personal expenses) may apply and will be communicated during the booking process.
• Currency conversion fees may apply for international transactions.

Cancellation by User:

• Cancellation requests must be submitted in writing through our Platform or by contacting our support team.
• Refund eligibility and amount depend on the cancellation policy of the respective Service Provider.
• Each tour or service may have different cancellation terms, which will be displayed at the time of booking.
• Processing fees or platform charges may be deducted from refunds as applicable.

Cancellation by Service Provider:

• Service Providers may cancel bookings due to insufficient participants, weather conditions, safety concerns, or other operational reasons.
• In such cases, you will be offered a full refund or alternative dates/services when possible.
• Plans2Pick is not liable for any additional costs or damages arising from Service Provider cancellations.

Force Majeure:

Neither Plans2Pick nor Service Providers shall be liable for cancellations or modifications due to events beyond reasonable control, including natural disasters, pandemics, war, civil unrest, government actions, or other force majeure events. Refunds in such situations will be handled on a case-by-case basis.

As a user of our Platform, you agree to:

• Accurate Information: Provide true, accurate, and complete information during registration and booking.
• Travel Documents: Ensure you have valid passports, visas, permits, and any other documents required for your travel. Plans2Pick is not responsible for denied entry due to invalid documents.
• Health & Fitness: Assess your physical fitness for adventure activities and disclose any medical conditions to Service Providers. Some activities may have age, health, or fitness restrictions.
• Insurance: We strongly recommend purchasing comprehensive travel insurance covering trip cancellation, medical emergencies, and personal belongings.
• Compliance: Follow all rules, guidelines, and instructions provided by Service Providers during your travel experience.
• Respectful Conduct: Behave responsibly and respectfully toward Service Provider staff, fellow travelers, local communities, and the environment.

Third-Party Services:

• When you book through our Platform, you are entering into a separate agreement with the Service Provider.
• Service Providers have their own terms and conditions, which apply to your booking in addition to these Terms.
• Plans2Pick is not a party to the contract between you and the Service Provider.

Service Quality:

• The quality, safety, and delivery of travel services are the sole responsibility of the Service Provider.
• While we endeavor to partner with reputable providers, we do not guarantee or warrant the quality of any services.
• Any complaints or disputes regarding service quality should be raised with the Service Provider directly.

Dispute Resolution:

Plans2Pick may assist in mediating disputes between users and Service Providers as a courtesy, but we are not obligated to resolve such disputes or provide compensation.

Platform Liability:

• Plans2Pick acts solely as an intermediary and is not liable for any acts, omissions, or negligence of Service Providers.
• We are not responsible for injuries, accidents, illness, death, property damage, or any other loss arising from travel services.
• Our liability is limited to the platform fees collected (if any) and does not extend to the cost of travel services.

Exclusions:

To the maximum extent permitted by law, Plans2Pick shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Personal injury or property damage during travel
• Service Provider insolvency or failure to deliver services
• Delays, cancellations, or changes by Service Providers

Our Content:

• All content on our Platform, including text, graphics, logos, images, and software, is owned by Plans2Pick or our licensors.
• You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

User Content:

• By submitting reviews, photos, or other content to our Platform, you grant us a non-exclusive, royalty-free license to use, display, and distribute such content.
• You represent that you own or have the right to share any content you submit.

Prohibited Uses:

• You may not use automated tools to scrape or extract data from our Platform.
• Commercial use of our content without authorization is prohibited.

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Platform, you consent to:

• The collection and processing of your personal data as described in our Privacy Policy
• Sharing necessary booking information with Service Providers to fulfill your reservations
• Receiving transactional communications related to your bookings

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our Platform with an updated "Last Updated" date.

Your continued use of the Platform after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

For material changes that significantly affect your rights, we will make reasonable efforts to notify registered users via email or prominent notice on our Platform.

Applicable Law:

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Dispute Resolution:

• Any disputes arising from these Terms or your use of our Platform shall first be attempted to be resolved through good-faith negotiation.
• If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.
• The arbitration shall be conducted in English, and the seat of arbitration shall be New Delhi, India.

Jurisdiction:

For any matters not subject to arbitration, the courts of New Delhi, India shall have exclusive jurisdiction.
